Terms of Service

Effective June 1, 2026

1. Agreement

These Terms of Service ("Terms") govern your use of DodoPicks (the "Service"), operated by DodoPicks ("DodoPicks," "we," "us"). By using the Service you agree to these Terms.

If you don't agree, don't use the Service.

2. Eligibility

You must be at least 13 years old (16 in the EU/UK) to use the Service. By using it you represent that you meet this requirement and are legally able to enter into these Terms.

3. The Service

3.1 What we do

DodoPicks uses AI to recommend products in response to user queries. We do not sell products. When you click a buy link we route you to a third-party retailer.

3.2 What we don't do

  • We do not process payments.
  • We do not ship products.
  • We do not provide product warranties or support — those are between you and the retailer or manufacturer.
  • We do not guarantee that a recommended product is the best for you. Our recommendations are informational.

3.3 Accuracy disclaimer

Prices, availability, and product details are provided by AI and may be out of date or wrong. Always verify on the retailer's website before purchasing. We are not liable for purchases made based on inaccurate recommendations.

4. Your account

  • You're responsible for the security of your account and credentials.
  • You agree to provide accurate information.
  • One account per person; no sharing or selling.
  • We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose.
  • Submit content that infringes intellectual property, violates privacy, or harasses others.
  • Attempt to reverse-engineer, scrape, or otherwise circumvent the Service.
  • Use the Service in a way that overloads our infrastructure.
  • Use automated tools to query the Service except via official APIs (once introduced).
  • Misrepresent your relationship with DodoPicks.

We may suspend or terminate access for violations.

6. Affiliate disclosure

We earn affiliate commissions when you purchase through some retailer links on our site. This does not affect which product we recommend. The pick is made first; the retailer is selected after, based on availability and (where applicable) your preferred retailer.

7. Intellectual property

7.1 Our property

The Service — including the software, design, brand, and aggregated/anonymized data — is owned by DodoPicks and protected by intellectual property laws.

7.2 Your content

You retain ownership of content you submit (searches, answers, saved items). You grant DodoPicks a non-exclusive, worldwide, royalty-free license to use this content to provide and improve the Service, including incorporating it into our knowledge graph in anonymized form.

7.3 Feedback

If you send us feedback, you grant us the right to use it without restriction or compensation.

8. Third-party services

The Service uses third-party services (LLM providers, image search, affiliate networks, hosting). Their terms govern your interactions with them through us. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOMMENDATIONS WILL MEET YOUR EXPECTATIONS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (a) $100 OR (b) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow these limitations; in those, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold DodoPicks harmless from any claim arising from your misuse of the Service or your violation of these Terms.

12. Governing law and disputes

12.1 Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

12.2 Arbitration (US users)

Any dispute will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), not in court, except that either party may seek injunctive relief in court for IP infringement.

You waive your right to a jury trial and to participate in a class action.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@dodopicks.com.

12.3 Users outside the US

Disputes involving users outside the US may be subject to local mandatory law. Where the arbitration clause is not enforceable, disputes will be resolved in the courts of California.

13. Changes

We may update these Terms. Material changes will be announced at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access at our discretion, with notice where practical, for violation of these Terms or for legitimate business reasons.

Provisions that by their nature should survive termination (intellectual property, indemnity, liability limits, dispute resolution) will survive.

15. Miscellaneous

  • Severability: if any provision is unenforceable, the rest remains in effect.
  • No waiver: failure to enforce a right is not a waiver of it.
  • Assignment: you may not assign these Terms; we may assign in connection with a business transfer.
  • Entire agreement: these Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Service.
